1. Acceptance of terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Josie de la Grana, operating as VestiaAI ("VestiaAI," "we," "us," or "our"), governing your access to and use of the VestiaAI mobile application, website at vestiaai.com, and all related services (the "Service").

By downloading the app, creating an account, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of service

VestiaAI is an AI-powered personal wardrobe assistant that helps users organize their clothing inventory and receive personalized outfit recommendations. The Service includes:

• AI-powered clothing item recognition and cataloguing via photo upload
• Daily outfit recommendations based on wardrobe inventory, weather conditions, calendar context, and personal style preferences
• Wardrobe organization, usage tracking, and declutter insights
• Shopping recommendations and affiliate links to retail partners
• A premium subscription tier with additional features

The Service is currently available as a beta product. Features, availability, and functionality may change during the beta period.

3. Eligibility

You must be at least 13 years old to use VestiaAI. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the Service, you represent and warrant that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

4. Accounts and registration

To use most features of VestiaAI, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials and not share them with others
• Notify us immediately at contact@vestiaai.com if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in any fraudulent activity.

5. Acceptable use

You agree to use VestiaAI only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload images that depict other people without their consent
• Upload illegal, obscene, defamatory, or otherwise objectionable content
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Use automated tools, bots, or scrapers to access the Service
• Attempt to gain unauthorized access to any portion of the Service or its infrastructure
• Use the Service to transmit malware, spam, or other harmful content
• Circumvent, disable, or interfere with security features of the Service
• Use the Service in any way that could disable, overburden, or impair its proper operation
• Create multiple accounts to circumvent free tier limitations or other restrictions
• Resell, sublicense, or otherwise commercialize access to the Service without our written consent

6. Your content

Ownership

You retain ownership of all photos, images, and other content you upload to VestiaAI ("Your Content"). We do not claim ownership over your wardrobe images or personal style data.

License you grant us

By uploading content to VestiaAI, you grant us a limited, non-exclusive, royalty-free license to store, process, and use Your Content solely for the purpose of providing and improving the Service to you. This includes processing your wardrobe images through AI vision systems to extract garment attributes.

We do not use your personal wardrobe images to train AI models for other users or for any purpose outside of providing your Service without your explicit consent.

Your representations

By uploading content, you represent that you own the content or have the right to upload it, and that it does not violate any third-party rights or applicable laws.

Deletion

You may delete Your Content at any time through the app. Upon account deletion, Your Content is permanently removed from our storage within 30 days as described in our Privacy Policy.

7. Our intellectual property

VestiaAI and its original content, features, functionality, design, code, AI models, and brand identity are owned by Josie de la Grana and protected by copyright, trademark, and other intellectual property laws.

The VestiaAI name, logo, and mark are trademarks of Josie de la Grana. You may not use our trademarks without prior written permission.

Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use the Service for its intended purpose.

8. Subscriptions and payments

Free tier

VestiaAI offers a free tier with access to core features subject to usage limits described in the app. We reserve the right to modify free tier limits at any time with reasonable notice.

Premium subscription

Premium features are available through a paid subscription billed through Apple's App Store. By subscribing, you agree to Apple's payment terms in addition to these Terms. All payments are processed by Apple — VestiaAI does not store your payment information.

Billing

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your iOS device's Subscriptions settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time.

Price changes

We may change subscription pricing with at least 30 days' notice. Continued use of the premium Service after a price change constitutes acceptance of the new price.

Refunds

All subscription purchases are made through the Apple App Store. Refund requests are subject to Apple's refund policies. We do not process refunds directly.

9. Affiliate recommendations

VestiaAI may display shopping recommendations for clothing and accessories through affiliate partnerships with third-party retailers. When you click these links and make a purchase, we may receive a commission from the retailer at no additional cost to you.

Affiliate recommendations are generated based on your wardrobe profile and identified style gaps. We do not accept payment from retailers to feature specific products — recommendations are determined by our AI systems based on your personal wardrobe data.

Purchases made through affiliate links are transactions between you and the retailer. VestiaAI is not a party to those transactions and is not responsible for product quality, pricing, availability, or any disputes arising from third-party purchases.

10. AI and styling disclaimer

Specifically:

• AI-generated garment classifications (color, formality, season) may occasionally be inaccurate. You can correct these manually within the app.
• Outfit recommendations are generated based on available context and may not account for all relevant factors including dress codes, cultural considerations, or personal circumstances.
• Weather-based recommendations depend on third-party weather data and location accuracy — dress appropriately for actual conditions.
• VestiaAI is not a licensed fashion consultant, personal stylist, or professional advisor of any kind.

11. Disclaimers of warranties

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.

12. Limitation of liability

Some jurisdictions do not allow the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless VestiaAI and its operator from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload to the Service.

14. Termination

You may stop using VestiaAI and delete your account at any time through the app's settings.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination:

• Your right to use the Service immediately ceases
• Your account data will be handled in accordance with our Privacy Policy
• Premium subscription access ends — any remaining subscription period will not be refunded
• Provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability

15. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved informally by contacting us at contact@vestiaai.com. If informal resolution fails, disputes shall be resolved in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent unauthorized use of intellectual property or other irreparable harm.

16. Changes to terms

We may update these Terms from time to time. We will notify you of material changes by email and by updating the "Last updated" date at the top of this page. For significant changes, we will provide at least 30 days' notice before the updated Terms take effect.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
